One important point that was missed was that the Senator’s Letter to the tax commissioner requested a response in writing to their intentions regarding Native brands was dated May 16, 20011. To date Commissioner Mattox has refused to answer this question. It was New York State Department of Taxation and Finance personnel that suggested this was a “gray area”. Even if the department believes the “area” is “gray”, their intentions or their policy can’t be. As I have said before; the state must either back off the Native to Native trade of Native products or they have to attempt to prohibit it. What is it, Mr. Mattox? If two State Senators can’t get an answer from you; who can?
